Additional Hearing Complaints Filed for Violations of Governor’s Proclamation

The Iowa Alcoholic Beverages Division (ABD) announced today that it has filed an additional five hearing complaints on businesses for violations of Governor Reynolds’ emergency public health disaster proclamation. 

Hearing complaints have been filed on the following establishments:

  1. Pour Bastards Pub in Newton On or about September 5, the licensee knowingly violated the Governor’s August 21 Proclamation of Disaster Emergency by: failing to ensure at least six feet of physical distance between each group or individual dining or drinking alone and by failing to ensure that all patrons had a seat at a table or bar. 

  2. Barefoot Bar in Spirit Lake On or about August 1, 3, 8 and 22, the licensee failed to comply with the Governor’s July 24 Proclamation of Disaster Emergency by: failing to ensure at least six feet of physical distance between each group or individual dining or drinking alone; failing to limit patrons from congregating together closer than six feet; and/or failing to implement reasonable measures for increased hygiene practices. 

  3. Kelly’s Little Nipper in Des Moines On or about September 11, the licensee failed to comply with the Governor’s August 27 Proclamation of Disaster Emergency by: failing to ensure at least six feet of physical distance between each group or individual dining or drinking alone; failing to ensure that all customers who were served alcoholic beverages were also served food; failing to separate booths closer than six feet with a barrier of sufficient height to fully separate customers; failing to ensure all patrons had a seat at a table, booth or bar; failing to limit patrons from congregating together closer than six feet; failing to ensure that all patrons were seated at a table, booth or bar while consuming their food and beverages; and/or failing to implement reasonable measures for increased hygiene practices. 

  4. Latitude 41 in Polk City On or about August 28, the licensee, knowingly violated the Governor’s August 27 Proclamation of Disaster Emergency by: failing to ensure at least six feet of physical distance between each group or individual dining or drinking alone, failing to prepare and serve food to all customers and by failing to ensure that all patrons had a seat at a table or bar. 

  5. Jalapeno Bar & Grill in Eagle Grove On or about August 30, the licensee failed to comply with the Governor’s August 21 Proclamation of Disaster Emergency by: failing to ensure at least six feet of physical distance between each group or individual dining or drinking alone; and/or, failing to ensure that all patrons had a seat at a table or bar. 

Hearing complaints can be viewed here. Each licensee listed above faces a civil penalty for their violations and has the right to a hearing. 

ABD continues to actively enforce compliance with Governor Reynolds' emergency public health disaster proclamation. Any licensed establishment in violation of the governor’s proclamation will be held accountable and risk a fine, suspension or revocation of its license.
